Avolta Loyalty Program Terms and Conditions
Introduction
The loyalty program for Dufry International, AG and its global subsidiaries and affiliates (collectively, “Avolta”) is Club Avolta hereinafter referred to as the “Avolta Loyalty Program”. The Avolta Loyalty Program operates under the terms and conditions as set out below unless otherwise expressly stated (the “Program Rules”). The Program Rules govern Avolta’s relationship with members of the Avolta Loyalty Program (collectively, “Avolta Loyalty Program Members” or “Members” and individually, a “Avolta Loyalty Program Member,” “Member,” or “you”), including how Members create and manage their accounts and achieve, maintain, and use Member benefits at Participating Stores (as defined below).
Except as otherwise expressly prohibited or limited by applicable laws, Avolta may at any time amend, modify or supplement these Program Rules (collectively “Program Rule Changes”). Your continued participation in the Avolta Loyalty Program will constitute your acceptance of any such Program Rule Changes. Loyalty Members are responsible for reading, understanding, and remaining knowledgeable of the Program Rules and any Program Rule Changes.
By opening an Avolta Loyalty Program membership account (“Account” or “Membership Account”) on the Avolta Loyalty Program website or mobile application or at Participating Stores (“Avolta Channels”), or by using the Membership Account number or QR code you were assigned (“Membership Identification”) to receive and user benefits of the Avolta Loyalty Program, you agree that:
• you have read and accept these Program Rules; and you have read and accept the Website Terms of Use which are incorporated by reference herein; and
• you have read and accept the terms of Avolta’s Privacy Policy and you consent to the collection, use, and disclosure of your personal data by Avolta, the Avolta Loyalty Program, Participating Stores (as defined below), and their authorized third-party agents and service providers in accordance with Avolta’s Privacy Policy.
All Avolta Loyalty Program benefits, offers, awards, prizes and services are subject to availability and may be changed by the Avolta at any time without notice. Avolta may terminate the Avolta Loyalty Program in whole or in part, with ninety (90) days advance notice to all active Members and with less or more than ninety (90) days’ notice in any jurisdiction if required to do so by applicable law. At Avolta’s sole discretion, Avolta may choose to substitute a similar loyalty program for the Avolta Loyalty Program at any time immediately upon notice to active Avolta Loyalty Program Members. If the Avolta Loyalty Program is terminated, all unused Member benefits will be forfeited without any obligation or liability, and no claims on Member benefits will be honored after the conclusion of the notice period.
Membership in the Avolta Loyalty Program
1.1 Eligibility
Membership in the Avolta Loyalty Program is free and available to any individual who: (a) possesses the legal authority to agree to the Program Rules; (b) resides in a jurisdiction which legally permits participation in the Avolta Loyalty Program; (c) is not a resident of Crimea, Cuba, Donetsk People’s Republic, Iran, Luhansk People’s Republic, North Korea, and Syria; (d) provides valid and accurate personal information when enrolling in the Avolta Loyalty Program; (e) is not already a member of the Avolta Loyalty Program (i.e., does not already have a Membership Account)

Enrollment in Avolta Loyalty Program
2.1 Avolta Loyalty Program Account
In order become an Avolta Loyalty Program Member and to access features and benefits of the Avolta Loyalty Program, you must successfully open and register for an account on the Avolta Loyalty Program through Avolta Channels. Once you have successfully registered, you will receive a personal QR code and Membership Account number that will allow you to identify yourself in Participating Stores (as defined below) and, thereafter, enjoy the benefits offered by the Avolta Loyalty Program. You are responsible for maintaining the confidentiality of your account password and for all activities that occur using your account. You agree not to share, let anyone else access or do anything else that might jeopardize the security of your password. You agree to notify Avolta if your password is lost, stolen or disclosed to an unauthorized third party, if there is any unauthorized use of your password or account, or if you learn of any other breach of security in relation to the Avolta Channels.
2.2 Individual Membership
Only individuals are eligible for Avolta Loyalty Program membership, and each individual must maintain only one Membership Account. All Avolta Loyalty Program accounts are individual Accounts and no joint or shared Accounts are permitted even if you reside within the same household. Avolta Loyalty Program benefits are non-transferable unless expressly stated otherwise.
2.3 Duplicate Accounts
A Member may not have one or more duplicate Accounts under the Avolta Loyalty Program at any time. If more than one Avolta Loyalty Program Membership Identification is assigned to an individual for the Avolta Loyalty Program, such individual will only receive Member benefits for one Membership Account. Duplicate Membership Accounts may be cancelled.
3.0 Participating Stores
“Participating Stores” are Avolta’s retail and food and beverage stores which are owned, managed, franchised, licensed, and operated by Avolta and participate in the Avolta Loyalty Program. Avolta may in its sole discretion add or remove Participating Stores at any time.
4.0 Membership Benefits
4.1 Membership Tiers: Avolta Loyalty features three membership tiers, each offering increasing benefits:
a) Silver
Entry level
5% discount on eligible purchases at retail Participating Stores, subject to certain limitations and exclusions, including but not limited to those set forth in these Program Rules and Exhibit A; and
Instant access upon joining.
(b) Gold
7% discount on eligible purchases at retail Participating Stores, subject to certain limitations and exclusions including but not limited to those set forth in these Program Rules and Exhibit A;
Achieved with 2,000+ points collected within 12 months; and
All Silver benefits, plus additional perks.
(c) Platinum
10% discount on eligible purchases at retail Participating Stores, subject to certain limitations and exclusions, including but not limited to those set forth in these Program Rules and Exhibit A;
Achieved with 5,000+ points collected within 12 months; and
All Gold benefits, plus exclusive advantages.
* Once a Member reaches Gold and then Platinum, the Member will stay in such status for 12 months. Every purchase the Member makes automatically extends a Member’s status for 12 additional months.
* Discounts cannot be applied to items that are already on promotion or subject to a discount, nor can it be combined with any other Avolta promotional vouchers or campaigns such as the VIP Voucher. VIP Vouchers are instore marketing promotions available to all Avolta customers at select Participating Stores which provide percentage savings on a second purchase triggered by spending a certain amount on a first purchase.
4.2 Food and Beverage Discount Program
For a limited time, Members in all Membership tiers are entitled to a five percent (5%) discount on regularly priced items at food and beverage Participating Stores subject to certain limitations and exclusions.
4.3 Points
Members can earn points in the Avolta Loyalty Program by making eligible purchases at Participating Stores. If purchases are cancelled or returned for a refund, points will not be earned on such purchases.
4.4 Partner Programs
All Members can participate in certain programs with third parties that have reward or loyalty programs such as hotels and airlines which have a business relationship with the Avolta Loyalty Program (Partner Programs). Partner Programs are available on the Avolta Loyalty Program Channels and subject to these Program Rules and the applicable Partner Program terms and conditions.
4.5 No Cash Value
Avolta Loyalty Program Member benefits cannot be redeemed for cash.
4.6 No Sale or Transfer
Except as expressly permitted in the Program Rules, Member benefits may not be sold, bartered or transferred (other than by Avolta or its agents). Any attempted transfer, sale or barter will be void and will be confiscated. Avolta and its partners may refuse to honor or recognize Member benefits which Avolta believes may have been transferred, sold or bartered.
4.7 Benefits Subject to Availability and Modification
All Avolta Loyalty Program benefits, amenities, offers, awards, prizes and services are subject to availability and may be changed at any time without notice.
4.8 Eligibility to Receive Benefits
By accepting any Avolta Loyalty Program benefits, amenities, offers, awards, prizes or services, you acknowledge that you are responsible for determining whether you are eligible to receive, and that you are eligible to receive, such Avolta Loyalty Program benefits, amenities, offers, awards, prizes, or services under applicable laws, gift policies and incentive policies. You must immediately notify Avolta if you are (i) not eligible to receive any Loyalty Program benefits, amenities, offers, awards, prizes or services at any time, or (ii) your Member Account has been credited with benefits that you have not earned or are not eligible to earn.
5.0 Membership Communication
5.1 Program Rules Changes Communication:
From time to time, all Members, whether they have opted into or out of receiving marketing communication, may receive communication from Avolta to their email address or phone number (i.e. SMS or WhatsApp) currently provided in their Account on any major updates or changes to these Program Rules.
5.2 Marketing Communication:
Members may receive communication from Avolta to their email address or phone number (i.e. SMS or WhatsApp) currently provided in their Account on promotions, offers, prizes, or other such communications if Members consent to receiving such information upon signing up for the Avolta Loyalty Program. Members may at any time withdraw their consent to receive such information by changing their setting by logging into their Account on Avolta Loyalty Program website on their desktop and changing preference through the link provided at the bottom of their Profile page or through the link provided in the footer of our email communications.
Cancelling or Suspending Membership Accounts
6.1 Cancelling by Member
You may cancel your membership in the Avolta Loyalty Program at any time by either (i) sending written notice of cancellation by email to clientservice@avolta.net with your email address used for registration of your Account as well as your Membership Account number. You will receive a confirmation email once your request has been received and processed; or (ii) clicking on the “Delete account” option under the Settings tap found in the Account tap at the bottom of their Account on the Avolta Loyalty Program mobile application
6.2 Cancelling or Suspending by Avolta
Avolta may cancel a Member’s benefits, suspend Avolta Loyalty Program benefits, or cancel a Member’s Account at any time with immediate effect and without written notice, for any reason and in Avolta's sole discretion including, without limitation, if Avolta believes the Member has:
(a) Acted in a manner inconsistent with applicable laws, regulations, ordinances;
(b) Failed to pay for purchases at Avolta stores;
(c) Acted in an inappropriate, fraudulent, abusive or hostile manner;
(d) Breached or violated any of these Program Rules or the Website Terms of Use;
(e) Engaged in any misconduct or wrongdoing in connection with the Avolta Loyalty Program including, without limitation, with respect to Avolta Loyalty Program Member benefits.
6.3 Legal Action
Nothing contained in these Program Rules will limit Avolta in the exercise of any legal or equitable rights or remedies.
7 Effect of Membership Cancellation
The Avolta Loyalty Program and other related benefits and services are the sole property of Avolta, and are not the property of Members. On cancellation of membership in the Avolta Loyalty Program for any reason, all benefits and services will be forfeited and a Member will no longer be able to participate in the Avolta Loyalty Program. All Avolta Loyalty Program benefits and services have no cash value and Avolta will not compensate or pay cash for any forfeited or unused benefits.
If Avolta cancels a Member’s Account for any reason, the Member may not reapply for membership in the Avolta Loyalty Program except in very limited circumstances at Avolta’s sole discretion, and any unauthorized Account opened in the Member’s name following cancellation, as well as any benefits and services earned in that Account will be forfeited upon discovery.
8. Other Conditions of Enrollment
8.1 Modification of Program
Except as otherwise expressly prohibited or limited by applicable laws, Avolta has the right to change, limit, modify or cancel the Program Rules, with or without notice, even though such changes may affect the value of Member’s benefits.
8.2 Monitoring Membership Accounts
To the fullest extent permitted by law, Avolta reserves the right to monitor the Accounts of all Members, at any time and without notice, for compliance with Program Rules.
8.3 Correction of Benefits
At any time and in Avolta’s sole discretion (including, without limitation, where a Member was not eligible to earn a specific benefit pursuant to these Program Rules), Avolta may correct the benefit that has been credited to a Member’s Account. Avolta also reserves the right, in its sole discretion, to prevent, cancel, or reconcile any transaction where the Loyalty Program suspects there has been fraudulent activity connected with the transaction.
9. No Warranties or Representations, Express or Implied
Avolta makes no warranties or representations, either expressed or implied, with respect to type, quality or fitness of goods or services provided through the Avolta Loyalty Program or by Participating Stores
10. Not Responsible for Acts, Errors, or Omissions
Avolta is not responsible for: (a) any loss or misdirection of, or delay in receiving, any Member application, correspondence, Member benefits; (b) theft or unauthorized redemption Member benefits; (c) any acts or omissions of third parties (including, without limitation, in Participating Store); or (d) any errors published in relation to the Avolta Loyalty Program, including, without limitation, any pricing or typographical errors, errors of description, errors regarding Participating Stores, and Avolta Loyalty Program affiliates, and errors in the crediting or debiting of Membership benefits from Member Accounts. Avolta reserves the right to correct, without notice, any errors.
11. Taxes
Member benefits may be subject to income or other taxes. The Member is responsible for paying all such taxes and for making all applicable disclosures to third parties. Avolta will not be liable for any tax liability, duty or other charges in connection with Member benefits.
12. Interpretation of Program Rules
All interpretations of these Program Rules regarding membership are at the Avolta’s sole discretion, and Avolta’s decisions will be final. In the event of any discrepancy between the English version and any translated version of these Program Rules, the English language version will govern.
13. Trademarks
Avolta and Participating Stores are the sole and exclusive owners or licensees of the trademarks, service marks, trade names, logos, and copyrighted or copyrightable materials of Dufry International, AG its affiliates, and the Participating Stores. Members shall never, directly or indirectly, interfere with, challenge, file applications for, or claim ownership of these trademarks anywhere in the world.
14. Waiver
Avolta’s waiver of any breach of these Program Rules by any Member will not constitute a waiver of any other prior or subsequent breach of these Program Rules. Avolta’s failure to insist upon strict compliance with these Program Rules by any Member will not be deemed a waiver of any rights or remedies Avolta may have against that or any other Member. Avolta may waive compliance with these Program Rules in its sole discretion and may run promotions from time to time that provide enhanced benefits to select Members.
15. Limitation of Liability
IN NO EVENT WILL DUFRY INTERNATIONAL, AG., ITS SUBSIDIARIES AND AFFILIATES, FRANCHISORS/FRANCHISEES OR LICENSORS/LICENSEES, ANY PARTICIPATING STORE, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH THE AVOLTA LOYALTY PROGRAM, THESE PROGRAM RULES, OR AVOLTA’S OPERATION OF THE AVOLTA LOYALTY PROGRAM.
16. Choice of Law and Venue
Any disputes arising out of or related to the Avolta Loyalty Program or these Program Rules will be handled individually without any class action, and will be governed by, construed and enforced in accordance with the laws of Switzerland without regard to its conflicts of law rules. The exclusive jurisdiction for any claim or action arising out of or relating to the Avolta Loyalty Program or the Program Rules may be filed only in the courts located in the Swiss Confederation.
17. Subject to Law
Membership in the Avolta Loyalty Program and Member benefits are subject to all applicable local laws and regulations. Membership in the Avolta Loyalty Program, Member benefits, are offered in good faith; however, they may not be available if prohibited or restricted by applicable law or regulation in a jurisdiction where a Member resides or a Participating Store is located. If any part of these Program Rules is held to be unlawful or unenforceable, that part will be deemed deleted from these Program Rules in such jurisdiction and the remaining provisions will remain in force.
18. Entire Agreement
The Program Rules, together with any other terms and conditions, rules, or regulations incorporated herein or referred to herein constitute the entire agreement between Avolta and Members relating to the subject matter hereof, and supersede any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on the Avolta Loyalty Program website or application.
